Possibo (“we”, “our,” or “us”) operates the website and services at https://possibo.com (the “Service”). These Terms of Service (“Terms”) govern your access to and use of the Service. By accessing or using Possibo you agree to comply with these Terms. If you do not agree, do not use the Service.
1. Acceptance; Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using Possibo you represent and warrant that you meet this eligibility requirement and have the authority to enter into these Terms.
2. Services Provided
Possibo provides free and premium trading signals for Forex, Crypto, Commodities, Stocks, and Market Indexes, market analysis, educational content, tools, and related services. All signals, analyses, and content are provided for informational and educational purposes only.
3. No Financial Advice; Risk Acknowledgement
You acknowledge and agree that:
- Possibo is not a registered broker, financial advisor, or investment manager. Nothing on the Service constitutes financial, investment, tax, legal, or professional advice.
- Trading financial instruments (including Forex, Crypto, Commodities, Stocks, and Indexes) involves substantial risk. You may lose some or all of your capital. Past performance is not indicative of future results.
- You are solely responsible for any trades you enter, any financial decisions you make, and for performing your own due diligence and risk management.
4. No Guarantee; “AS IS” Disclaimer
All content, signals, tools, and services are provided “AS IS” and “AS AVAILABLE” without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, or uninterrupted service. We do not guarantee any particular outcome or profit.
5. No Refunds; Payment Terms
- No refunds. All payments for subscriptions, one-time purchases, and services are non-refundable, except as required by applicable law.
- Subscriptions renew automatically at the then-current price until cancelled. You may cancel at any time; cancellations stop future billing but do not entitle you to refunds for fees already paid.
- You authorize recurring charges through your chosen payment method. Fees, taxes, and other charges are your responsibility.
6. User Representations & Responsibilities
By using Possibo you represent and agree that you will:
- Use the Service lawfully and not for any fraudulent, unlawful, or manipulative purpose.
- Not copy, resell, distribute, or republish signals, premium content, or proprietary data without prior written permission.
- Maintain the confidentiality of your account credentials and immediately notify us of any unauthorized access. You are liable for all activity on your account.
7. Intellectual Property
All content, trademarks, logos, data, code, images, and materials on Possibo are our exclusive property or used under license. You are granted a limited, non-transferable license to access the Service for personal use in accordance with these Terms. Unauthorized use may result in termination and legal action.
8. Third-Party Services
We may include references or links to third-party tools, brokers, or resources. We do not endorse or control these third parties and are not responsible for their content, policies, or actions. Use of third-party services is at your own risk.
9. Indemnification
You agree to indemnify, defend, and hold harmless Possibo, its officers, directors, employees, agents, affiliates, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or related to:
- Your breach of these Terms;
- Your use of the Service;
- Your trading decisions or losses;
- Your violation of any law or the rights of a third party.
10. Limitation of Liability
To the fullest extent permitted by law:
- Possibo’s total aggregate liability to you for any claim arising from or relating to the Service is limited to the total fees you paid to Possibo in the 12 months preceding the claim (or $100 USD if greater).
- In no event will Possibo be liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
11. Termination and Suspension
We may suspend or terminate your access at any time, with or without cause, including for suspected misuse, breach of these Terms, non-payment, or if required by law. Upon termination, your right to access and use paid features ends; you will not receive refunds for prepaid fees.
12. Dispute Resolution; Arbitration; Class Action Waiver
- Informal resolution. If a dispute arises, please contact us at legal@possibo.com so we can try to resolve it informally.
- Arbitration. Except where prohibited by law, you and Possibo agree to resolve disputes through final and binding arbitration under the rules of [an established arbitral institution appropriate to your jurisdiction].
- Class action waiver. To the fullest extent permitted by law, you agree to bring claims only on an individual basis, not as a class or representative action.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of Rwanda (without regard to choice-of-law rules). Any court with competent jurisdiction in Kigali, Rwanda will hear matters that are not subject to arbitration.
14. Privacy & Data
Our Privacy Policy explains how we collect, use, and share personal information. By using the Service you agree to the Privacy Policy. You are responsible for complying with applicable data-export and privacy laws.
15. Changes to the Service and Terms
We may modify or discontinue features or content at any time. We may update these Terms from time to time; changes are effective upon posting. Continued use after changes constitutes acceptance.
16. Severability; Waiver; Entire Agreement
If any provision is held invalid, the remaining provisions remain in force. Failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and any purchase terms, constitute the entire agreement.
